(Photography & Aerial Videography Services)

1. Definitions
- “Company” refers to Skyview Aerial Photography and Videography.
- “Client” refers to the individual or organization commissioning the services.
- “Media” refers to all photos, videos, and digital assets produced by the Company.
2. Booking & Scheduling
- A booking is confirmed only after the Client accepts the estimate/invoice and submits the required non‑refundable deposit.
- The Client is responsible for providing accurate project details, locations, and timelines.
- The Client must ensure all necessary permissions for filming or photography at the location.
3. Aerial Operations & FAA Compliance
- All drone operations are conducted in accordance with FAA Part 107 regulations.
- Flights may be delayed, modified, or canceled due to:
- Weather conditions
- Airspace restrictions
- Safety concerns
- Local or federal regulations
- The Company has full authority to determine whether a flight can be safely conducted.
4. Client Responsibilities
- The Client must ensure safe, legal access to the property or location.
- An authorized representative should be present during the shoot to approve compositions and angles.
- If no representative is present, the Company’s creative judgment is considered acceptable.
5. Reshoots
- Client‑requested reshoots are billed at full rate plus any additional expenses.
- Reshoots due to weather, third‑party issues, or acts of God may incur expenses only, at the Company’s discretion.
6. Payment Terms
- Payment terms are defined in each Client’s estimate or invoice.
- Deposits are non‑refundable.
- The remaining balance is due before delivery of final media, unless otherwise agreed in writing.
- Late payment fees may apply and are included in the Client’s estimate/invoice.
7. Cancellation Policy
- Cancellations made 7 or more days before the scheduled shoot: deposit is retained.
- Cancellations made less than 7 days before the scheduled shoot: Client is responsible for 25% of the total project cost, in addition to the non‑refundable deposit.
- Weather‑related cancellations may be rescheduled at no additional charge.
8. Copyright & Usage Rights
- The Company retains full copyright to all media created.
- The Client receives a non‑exclusive, non‑transferable license for the agreed‑upon usage (e.g., marketing, real estate listing, social media).
- Media may not be resold, altered, or redistributed without written permission.
- The Company may use media for portfolio, marketing, and promotional purposes unless the Client requests otherwise in writing.
9. Deliverables
- Standard delivery includes edited photos and/or videos in digital format.
- Turnaround time is typically three to ten business days, depending on the scope and editing needs of the project, unless otherwise stated in the estimate or invoice.
- Raw files are not included unless purchased separately.
10. Liability
- The Company is not liable for:
- Delays caused by weather, equipment failure, or unsafe conditions
- Property damage caused by factors outside the Company’s control
- Losses resulting from project delays or cancellations
- The Client agrees to indemnify the Company against claims arising from unsafe conditions or unauthorized filming locations.
11. Limitations of Aerial Filming
- Drone flights cannot occur:
- Near airports or in restricted airspace without proper authorization
- Over crowds or moving vehicles
- During high winds, rain, or hazardous weather
- Indoors, unless approved
- The Company may refuse any flight deemed unsafe or illegal.
12. Revisions
- Packages typically include two rounds of revisions.
- Additional revisions beyond the included rounds are billed at the hourly rate listed in the Client’s estimate/invoice.
13. Privacy
- The Client is responsible for notifying occupants, neighbors, or relevant parties of aerial filming.
- The Company complies with all privacy and data‑protection laws.
14. Governing Law
- These Terms & Conditions are governed by the laws of the state of Pennsylvania, unless otherwise specified.
